Jennifer has extensive experience with the creation of condominium and townhome regimes. She works with high-rise residential condominiums, garden style residential condominiums, commercial condominiums, condominium hotels, conversions of multi-family projects to condominiums and mixed-use master condominium projects.

Jennifer provides practical solutions to structuring and creating condominiums and townhomes. She guides clients through the statutory requirements of the Texas Uniform Condominium Act, including the requirements for a condominium information statement, declaration, association documents, rules and regulations, purchase contracts, reservation agreements and other documents. In addition, Jennifer assists clients in complying with the federal Interstate Land Sales Full Disclosure Act registration and disclosure requirements, with meeting and achieving federal financing pre-approval (FNMA and FHA) and with association issues that arise during the developer’s control period. She also advises and works with third party service providers such as surveyors, architects, property managers and marketing personnel to promote a smooth development process and a successful project.

PRACTICE AREA: MIXED-USE DEVELOPMENTS

Many mixed-use projects in Texas have a master condominium structure in order to divide ownership within the project. As a logical extension of Jennifer’s condominium practice, Jennifer works with numerous mixed-use projects. She has experience with a variety of uses within mixed-use developments, including residential, commercial, hotel, office, retail, resort and other components. Jennifer helps the client to address the impacts of the various uses on the development and assist with creating a functional and unified development.

RESORT DEVELOPMENT AND HOSPITALITY

Jennifer has a broad background with resort developments and urban hotel developments, many of which are mixed-use developments or involve a condominium component. Jennifer represents clients in connection with structuring the deals and negotiating the hotel management agreements, license agreements, technical support agreements and other agreements involving the hotel operator. She also works with condo-hotels and assists clients with SEC guidelines affecting the structuring and sales process.

PRACTICE AREA: INTERSTATE LAND SALES FULL DISCLOSURE ACT

Some clients are surprised to find out that their development is subject to a federal act. The federal Interstate Land Sale Full Disclosure Act applies to condominiums and townhomes, as well as single family lot developments and other real estate developments. Jennifer works with clients to comply with the exemptions or to register under the Interstate Land Sales Full Disclosure Act. She also advises clients on compliance with marketing provisions and restrictions under the Interstate Land Sales Full Disclosure Act.
